Terms of service

NOTICE — “PICKUP IN 5+ DAYS”  
Selecting “Pickup in 5+ Days” does not mean the item is in stock at our store. It indicates the product can be ordered and typically prepared for pickup in approximately five or more business days. Actual lead times vary by supplier and availability. If you need a precise ETA, contact us before ordering at sales@traqlab.com.

1. ACCEPTANCE OF TERMS  
By accessing and using the TRAQLAB website (the “Site”), booking experiences, or purchasing products (collectively, the “Services”), you (“User” or “Customer”) agree to these Terms of Service (the “Terms”). If you do not agree, please do not use the Services.

2. CHANGES TO TERMS  
TRAQLAB may update these Terms at any time. Changes take effect upon posting to the Site, with the “Last updated” date revised. Continued use of the Services constitutes acceptance of the updated Terms.

3. ELIGIBILITY  
You affirm you are the age of majority in your province or territory and legally able to enter binding contracts. If you open an account on behalf of a company, you represent that you are authorized to bind that company.

4. USE OF THE SITE  
Use the Services only for lawful purposes. You may not violate laws or others’ rights, upload malicious code, scrape or attempt to bypass access or security controls, or interfere with other users’ use of the Services.

5. PRODUCT AND SERVICE INFORMATION; PRICING; AVAILABILITY  
We aim for accuracy but errors may occur in descriptions, images, pricing, or availability. We may cancel or refuse any order affected by error or suspected fraud, even after submission, and will refund any amount paid. Unless stated otherwise, prices are in CAD and exclude taxes, shipping, duties, and fees. Availability labels such as “In Stock,” “Backorder,” “Order-to-Stock,” or “Pickup in 5+ Days” are estimates only. Preorders and special orders are fulfilled as inventory arrives from suppliers.

6. ORDERS, PAYMENT, AND VERIFICATION  
Placing an order is an offer to buy subject to these Terms and our policies. All orders require valid payment authorization; we may place a pre-authorization hold and cancel orders we cannot verify. We may request ID and the original payment card for in-store pickup or high-value orders. We reserve the right to limit quantities, refuse service, or cancel orders (with a refund) at our discretion.

7. SHIPPING, DELIVERY, AND PICKUP  
See our Shipping Policy for methods and costs. Title and risk of loss pass to you when we hand items to the carrier or upon pickup. Inspect packages at delivery or pickup and report damage or shortages within 48 hours to sales@traqlab.com. Undeliverable or refused shipments may incur return shipping and handling fees.

8. RETURNS, REFUNDS, AND FEES  
Returns are governed by our Return and Refund Policy. Applicable restocking fees and, when refunding to the original payment method, a 6% cancellation fee may be deducted. The fee is waived if you choose store credit or where prohibited by law. Shipping costs are non-refundable unless required by law or where we are at fault.

9. BOOKINGS AND EXPERIENCES (SESSIONS, PARTIES, CORPORATE EVENTS, COACHING)
Booking terms, including no-show and late arrival rules, are shown at checkout or on the booking page. If you cancel and request a refund to your original payment method, a 6% cancellation fee applies; this fee is waived if you opt for store credit. If TRAQLAB cancels or cannot provide the service, fees do not apply. You agree to comply with staff instructions and safety rules. We may refuse or end a session for unsafe behavior, intoxication, or policy violations without refund if the session has begun.

10. USER ACCOUNTS AND SECURITY  
You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any suspected compromise.

11. REVIEWS AND USER CONTENT  
If you submit reviews, media, or other content, you grant TRAQLAB a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that content for marketing and operational purposes. Do not submit unlawful, infringing, or misleading content. We may remove content at our discretion.

12. WARRANTIES AND DISCLAIMERS  
Except as expressly stated by TRAQLAB in writing, products may be covered by the manufacturer’s warranty only. We pass through any applicable manufacturer terms. Open-box or clearance items may be sold as-is where permitted by law. To the maximum extent permitted by law, the Services and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. LIMITATION OF LIABILITY  
To the fullest extent permitted by law, TRAQLAB and its directors, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits or revenue; or data loss arising from or related to the Services or products. Our total liability for any claim is limited to the amount you paid to TRAQLAB for the product or service giving rise to the claim. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the maximum extent permitted.

14. INTELLECTUAL PROPERTY  
All Site content, including text, graphics, logos, images, video, and software, is the property of TRAQLAB or its licensors and protected by Canadian and international laws. No rights are granted except as expressly set out in these Terms.

15. PRIVACY  
Your use of the Services is also governed by our Privacy Policy. Please review it to understand how we collect, use, and disclose personal information.

16. GOVERNING LAW  
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.

17. DISPUTE RESOLUTION, ARBITRATION, AND CLASS-ACTION WAIVER  
Except for claims qualifying for provincial small-claims court, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration under the Arbitration Act (Alberta) in Edmonton, Alberta, in English. You and TRAQLAB waive any right to a jury trial and agree not to participate in a class or representative action against the other. If a court finds the class-action waiver unenforceable, this section is severed and the dispute will proceed in court.

18. TERMINATION  
We may suspend or terminate access to the Services at any time, including for breach of these Terms or suspected fraud or abuse. You remain responsible for charges and obligations incurred before termination.

19. FORCE MAJEURE  
We are not responsible for delays or failures caused by events beyond our reasonable control, including supplier delays, strikes, acts of God, pandemics, or carrier issues.

20. SEVERABILITY, NO WAIVER, AND ASSIGNMENT  
If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or sale of assets.

21. ENTIRE AGREEMENT  
These Terms, together with linked policies (Privacy Policy, Return and Refund Policy, Shipping Policy, and booking terms), constitute the entire agreement between you and TRAQLAB and supersede prior understandings regarding the Services.
